§ 58‑33A‑35. (Effective July 1, 2010) Nonresident license reciprocity.

(a)        Unless deniedlicensure pursuant to G.S. 58‑33A‑45, a nonresident person shallreceive a nonresident public adjuster license if the person meets all of thefollowing criteria:

(1)        The person iscurrently licensed as a resident public adjuster and in good standing in his orher home state.

(2)        The person hassubmitted the proper request for licensure, has paid the fees required by G.S.58‑33‑125, and has provided proof of financial responsibility asrequired in G.S. 58‑33A‑50.

(3)        The person hassubmitted or transmitted to the Commissioner the appropriate completedapplication for licensure.

(4)        The person's homestate awards nonresident public adjuster licenses to residents of this State onthe same basis.

(b)        The Commissionermay verify the public adjuster's licensing status through the producer databasemaintained by the NAIC, its affiliates, or subsidiaries.

(c)        As a condition tocontinuation of a public adjuster license issued under this section, thelicensee shall maintain a resident public adjuster license in his or her homestate. The nonresident public adjuster license issued under this section shallterminate and be surrendered immediately to the Commissioner if the home statepublic adjuster license terminates for any reason, unless the public adjusterhas been issued a license as a resident public adjuster in his or her new homestate. Notification to the state or states where nonresident license is issuedmust be made as soon as possible, yet no later than 30 days after change in newstate resident license. Licensee shall include new and old address. A new stateresident license is required for nonresident licenses to remain valid. The newstate resident license must have reciprocity with the licensing nonresidentstate(s) for the nonresident license not to terminate.  (2009‑565, s. 1.)
