§ 58-40-105. Hearing and judicial review.

§58‑40‑105.  Hearing and judicial review.

(a)        Any insurer,person, or organization to which the Commissioner has directed an order ordecision made without a hearing may, within 30 days after notice to it of theorder or decision, make written request to the Commissioner for a hearingthereon.  The Commissioner shall hear the party or parties within 20 days afterreceipt of the request and shall give not less than 10 days' written notice ofthe time and place of hearing.  Within 15 days after the hearing, theCommissioner shall affirm, reverse, or modify his previous action, and specifyhis reasons therefor.  Pending such hearing and decision thereon, theCommissioner may suspend or postpone the effective date of his previous action.

(b)        Any order or decisionof the Commissioner shall be subject to judicial review as provided in Article2 of this Chapter. (1977, c. 828, s. 2.)
