§ 58‑58‑220. Approval of viatical settlement contracts and disclosure statements.

A person shall not use acontract or provide to a viator a disclosure statement form in this Stateunless filed with and approved by the Commissioner. The Commissioner shalldisapprove a contract form or disclosure statement form if, in theCommissioner's opinion, the contract or provisions contained therein areunreasonable, contrary to the interests of the public, or otherwise misleadingor unfair to the viator. The Commissioner may also require the submission ofadvertising material. (2001‑436, s. 3.)
