§58‑67‑180. Confidentiality of medical information.
Any data or informationpertaining to the diagnosis, treatment, or health of any enrollee or applicantobtained from such person or from any provider by any health maintenanceorganization shall be held in confidence and shall not be disclosed to anyperson except to the extent that it may be necessary to carry out the purposesof this Article; or upon the express consent of the enrollee or applicant; orpursuant to statute; or pursuant to court order for the production of evidenceor the discovery thereof; or in the event of claim or litigation between suchperson and the health maintenance organization wherein such data or informationis pertinent. A health maintenance organization shall be entitled to claim anystatutory privileges against such disclosure which the provider who furnishedsuch information to the health maintenance organization is entitled to claim.
