§58‑71‑155.  Bondsman to furnish power of attorney with securities.

With the securities depositedwith the Commissioner, the professional bondsman shall at the same time deliverto the Commissioner of Insurance a power of attorney, on a form supplied by theCommissioner, executed and acknowledged by the professional bondsmanauthorizing the sale or transfer of said securities or any part thereof. Thepower of attorney shall read as follows:

AUTHORIZING THE COMMISSIONER OF INSURANCE TO

SELL, OR TRANSFER SECURITIES DEPOSITED BY

PROFESSIONAL BONDSMEN IN

NORTH CAROLINA

KNOW ALL MEN BY THESEPRESENTS, That ______________, a professional bondsman, located in the Countyof __________, in the State of _______________, has authorized and appointedfor himself, his successors, heirs and assigns, the Commissioner of Insuranceof the State of North Carolina, in the name and in behalf of said professionalbondsman, his true and lawful attorney to sell or transfer any securitiesdeposited or that may be deposited, by said professional bondsman with saidCommissioner, under the laws and regulations requiring a deposit of securitiesto be made by professional bondsmen doing business in the State of NorthCarolina, insofar as the sale or transfer is deemed necessary by theCommissioner of Insurance to pay any liability arising under a bond whichpurports to be given by the undersigned bondsman in any county in this Stateand execution has been issued against said bondsman pursuant to a judgment onthe bond and the same has not been satisfied. The securities so deposited areto be held in trust by the Commissioner for the sole protection and benefit ofthe holder of bail bonds executed by, or on behalf of, the undersignedbondsman.
