§ 58-84-60. Immunity. - North Carolina Statutes

§ 58‑84‑60. Immunity.

A person serving on a localboard of trustees of the Firefighters' Relief Fund shall be immune individuallyfrom civil liability for monetary damages, except to the extent covered byinsurance, for any act or failure to act arising out of this service, exceptwhere the person:

(1)        Was not actingwithin the scope of that person's official duties;

(2)        Was not acting ingood faith;

(3)        Committed grossnegligence or willful or wanton misconduct that resulted in the damages orinjury;

(4)        Derived an improperpersonal financial benefit, either directly or indirectly, from thetransaction; or

(5)        Incurred theliability from the operation of a motor vehicle. (2007‑54, s. 1; 2007‑246,s. 8.1.)
