§ 58‑89A‑170. Prohibited acts.

No person shall do any of thefollowing:

(1)        Engage in or offerprofessional employer services without holding a license under this Article asa professional employer organization.

(2)        Use the name ortitle "staff leasing company", "employee leasing company","licensed staff leasing company", "staff leasing servicescompany", "professional employer organization", or"administrative employer" or otherwise represent that the person islicensed under this Article unless the person holds a license issued under thisArticle.

(3)        Represent as theperson's own the license of another person or represent that a person islicensed if the person does not hold a license.

(4)        Give materiallyfalse or forged evidence to the Commissioner in connection with obtaining ormaintaining a license or in connection with disciplinary proceedings under thisArticle.

(5)        Use or attempt touse a license that has been suspended or terminated. (2002‑168, s. 8; 2004‑162,s. 1.)
