§6‑22.  Petitioner to pay costs in certain cases.

The petitioner shall pay thecosts in the following proceedings:

(1)        In petitions fordraining or damming lowlands where the petitioner alone is benefited.

(2)        In petitions forcondemnation of water millsites when the petitioner is allowed to erect themill; but when he is not allowed to erect the mill, the costs shall be paid bythe person who is allowed to do so.

(3)        In petitions forcondemnation of land for railroads, street railways, telegraph, telephone orelectric power or light companies, or for water supplies for publicinstitutions, or for the use of other quasi‑public or municipalcorporations; unless in the opinion of the superior court the defendantimproperly refused the privilege, use or easement demanded, in which case thecosts must be adjudged as to the court may appear equitable and just.
