§ 66-111. Remedies.

§66‑111.  Remedies.

(a)        If a loan brokeruses any untrue or misleading statements in connection with a loan brokeragecontract, fails to fully comply with the requirements of this Article, fails tocomply with the terms of the contract or any obligation arising therefrom, orfails to make diligent effort to grant a loan to or procure a loan on behalf ofthe prospective borrower, then, upon written notice to the broker, theprospective borrower may void the contract, and shall be entitled to receivefrom the broker all sums paid to the broker, and recover any additional damagesincluding attorney's fees.

(b)        Upon complaint ofany person that a loan broker has violated the provisions of this Article, thesuperior court shall have jurisdiction to enjoin that defendant from furthersuch violations.

(c)        The remediesprovided herein shall be in addition to any other  remedies provided for by lawor in equity.

(d)        The violation ofany provisions of this Article shall constitute an unfair practice under G.S.75‑1.1. (1979, c. 705, s. 1.)
