§75‑32. Representation of winning a prize.
No person, firm or corporationengaged in commerce shall, in connection with the sale or lease or solicitationfor the sale or lease of any goods, property, or service, represent that anyother person, firm or corporation has won anything of value or is the winner ofany contest, unless all of the following conditions are met:
(1) The recipient of theprize must have been selected by a method in which no more than ten percent(10%) of the names considered are selected as winners of any prize;
(2) The recipient of theprize must be given the prize without any obligation; and
(3) The prize must bedelivered to the recipient at no expense to him, within 10 days of therepresentation.
The use of any language that has atendency to lead a reasonable person to believe he has won a contest oranything of value, including but not limited to "congratulations,"and "you are entitled to receive," shall be considered arepresentation of the type governed by this section. (1979,c. 879, s. 1.)
