§ 77‑92.  Membership;terms of office; eligibility for appointment.

(a)        The Roanoke RiverBasin Bi‑State Commission shall consist of 18 members with each stateappointing nine members. The North Carolina delegation to the Commission shallconsist of the six members of the General Assembly of North Carolina appointedto the North Carolina Roanoke River Basin Advisory Committee and threenonlegislative members of the North Carolina Roanoke River Basin AdvisoryCommittee, established pursuant to G.S. 77‑103, who represent differentgeographical areas of the North Carolina portion of the Basin and who residewithin the Basin's watershed, to be appointed by the Governor of NorthCarolina. The Virginia delegation to the Commission shall be appointed asdetermined by the Commonwealth of Virginia.

(b)        Members of theNorth Carolina House of Representatives, the North Carolina Senate, theVirginia House of Delegates, the Virginia Senate, and federal legislators, whohave not been appointed to the Commission and whose districts include anyportion of the Basin, may serve as nonvoting ex officio members of theCommission.

(c)        Except as providedin this subsection, members of the North Carolina delegation to the Commissionshall serve at the pleasure of the Governor of North Carolina. The Governor ofNorth Carolina may not remove a legislative member of the North Carolinadelegation to the Commission during the legislator's term of office, exceptthat the Governor may remove any member of the North Carolina delegation to theCommission for misfeasance, malfeasance, or nonfeasance as provided in G.S.143B‑13. A legislative member of the North Carolina delegation to theCommission who ceases to be a member of the General Assembly of North Carolinashall cease to be a member of the Commission. The terms of members of theVirginia delegation to the Commission shall be determined by the Commonwealthof Virginia.

(d)        Each state'sdelegation to the Commission may meet separately to discuss Basin‑relatedissues affecting their state and may report their findings independently of theCommission. (2002‑177,s. 1; 2005‑37, ss. 2, 3.)
