Institution, Docketing, and Transferring Civil Causesin the Trial Divisions.

§ 7A‑255.  Clerk of superior court processes allactions and proceedings.

All civil actions and proceedings in the General Court of Justice areinstituted in, and the original records thereof are maintained in, the officeof the clerk of superior court, without regard to the trial divisions in whichthe cause is pending from time to time. When the commencement of an action orproceeding requires issuance of summons, the clerk of superior court issues thesummons, and such summons runs and is valid as general process of the Statewithout regard to the trial division in which the action or proceeding may bepending from time to time.
