§ 7A‑47.1. Jurisdiction in vacation or in session.
In any case in which the superior court in vacation has jurisdiction,and all the parties unite in the proceedings, they may apply for relief to thesuperior court in vacation, or during a session of court, at their election. Any regular resident superior court judge of the district or set of districtsas defined in G.S. 7A‑41.1(a) and any special superior court judgeresiding in the district or set of districts and the judge regularly presidingover the courts of the district or set of districts have concurrentjurisdiction throughout the district or set of districts in all matters andproceedings in which the superior court has jurisdiction out of session;provided, that in all matters and proceedings not requiring a jury or in whicha jury is waived, any regular resident superior court judge of the district orset of districts and any special superior court judge residing in the districtor set of districts shall have concurrent jurisdiction throughout the districtor set of districts with the judge holding the courts of the district or set ofdistricts and any such regular or special superior court judge, in the exerciseof such concurrent jurisdiction, may hear and pass upon such matters andproceedings in vacation, out of session or during a session of court.
