§ 7B-4002. (For effective date - see note) Implementation of the Compact.

§ 7B‑4002.  (Foreffective date – see note) Implementation of the Compact.

(a)        The North CarolinaState Council for Interstate Juvenile Supervision is hereby established. TheSecretary of the Department of Juvenile Justice and Delinquency Prevention, orthe Secretary's designee, shall serve as the Compact Administrator for theState of North Carolina and as North Carolina's Commissioner to the InterstateCommission. The Secretary of the Department of Juvenile Justice and DelinquencyPrevention, or the Secretary's designee, is a member of the State Council andserves as chairperson of the State Council. In addition to the chairperson, theState Council shall consist of 10 members as follows:

(1)        One memberrepresenting the executive branch, to be appointed by the Governor;

(2)        One member from avictim's assistance group, to be appointed by the Governor;

(3)        One at‑largemember, to be appointed by the Governor;

(4)        One member of theSenate, to be appointed by the President Pro Tempore of the Senate;

(5)        One member of theHouse of Representatives, to be appointed by the Speaker of the House ofRepresentatives;

(6)        A district courtjudge, to be appointed by the Chief Justice of the Supreme Court; and

(7)        Four membersrepresenting the juvenile court counselors, to be appointed by the Secretary ofthe Department of Juvenile Justice and Delinquency Prevention.

(b)        The State Councilshall meet at least twice a year and may also hold special meetings at the callof the chairperson. All terms are for three years.

(c)        The State Councilmay advise the Compact Administrator on participation in the InterstateCommission activities and administration of the Compact.

(d)        The members of theState Council shall serve without compensation but shall be reimbursed fornecessary travel and subsistence expenses in accordance with the policies ofthe Office of State Budget and Management.

(e)        The State Councilshall act in an advisory capacity to the Secretary of the Department ofJuvenile Justice and Delinquency Prevention concerning this State'sparticipation in Interstate Commission activities and other duties as may bedetermined by each member state, including recommendations for policyconcerning the operations and procedures of the Compact within this State.

(f)         The Governor shallby executive order provide for any other matters necessary for implementationof the Compact at the time that it becomes effective, and, except as otherwiseprovided for in this section, the State Council may promulgate rules orregulations necessary to implement and administer the Compact.
