§ 88B-22. Licenses required; criminal penalty.

§ 88B‑22.  Licensesrequired; criminal penalty.

(a)        (Effective untilJuly 1, 2010) Except as provided in this Chapter, no person may practice orattempt to practice cosmetic art for pay or reward in any form, either directlyor indirectly, without being licensed as an apprentice, cosmetologist,esthetician, or manicurist by the Board.

(a)        (Effective July1, 2010) Except as provided in this Chapter, no person may practice orattempt to practice cosmetic art for pay or reward in any form, either directlyor indirectly, without being licensed as an apprentice, cosmetologist,esthetician, natural hair care specialist, or manicurist by the Board.

(b)        Except as providedin this Chapter, no person may practice cosmetic art or any part of cosmeticart, for pay or reward in any form, either directly or indirectly, outside of alicensed cosmetic art shop.

(c)        No person may openor operate a cosmetic art shop in this State unless a license has been issuedby the Board for that shop.

(d)        (Effective untilJuly 1, 2010) An individual licensed as an esthetician or manicurist maypractice only that part of cosmetic art for which the individual is licensed.

(d)        (Effective July1, 2010) An individual licensed as an esthetician, natural hair carespecialist, or manicurist may practice only that part of cosmetic art for whichthe individual is licensed.

(d1)      No person may teachcosmetic art in a Board‑approved cosmetic art school unless the person isa teacher licensed under this Chapter. A guest lecturer may be exempt from therequirements of this subsection upon approval by the Board.

(e)        An apprenticelicensed under the provisions of this Chapter shall apprentice under the directsupervision of a cosmetologist. An apprentice shall not operate a cosmetic artshop.
