§ 90A‑80. Investigationof complaints.
(a) Misconduct. Aperson may refer to the Board charges of fraud, deceit, negligence,incompetence, or misconduct against any certified contractor or inspector. Thecharges shall be in writing and sworn to by the complainant and submitted tothe Board. These charges, unless dismissed without a hearing by the Board asunfounded or trivial, shall be heard and determined by the Board in accordancewith the provisions of Chapter 150B of the General Statutes. An associationthat receives professional recognition of its own certification process by theBoard shall be responsible for the conduct and competency of its members.
(b) Records. TheBoard shall establish and maintain detailed records regarding complaintsconcerning each certified contractor or inspector. The records shall includethose certified by recognized associations. The records shall also detail thelevels of certification held by each contractor or inspector.
(c) Notification. TheBoard shall provide local health departments with notification of changes incertifications, complaints, suspensions, or reinstatements under this Article. (2006‑82, s. 1.)
