§ 93A-38. Suspension, revocation or denial of license.

§ 93A‑38.  Suspension,revocation or denial of license.

The Commission shall have thepower to suspend, revoke, deny issuance, or deny renewal of license to operatea private real estate school. In all proceedings to suspend, revoke or deny alicense, the provisions of Chapter 150B of the General Statutes shall beapplicable. The Commission may suspend, revoke, or deny such license when itfinds:

(1)        That the applicantfor or holder of such license has refused or failed to comply with any of theprovisions of this Article or the rules or regulations promulgated thereunder;

(2)        That the applicantfor or holder of such license has knowingly presented to the Commission falseor misleading information relating to matters within the purview of theCommission under this Article;

(3)        That the applicantfor or holder of such license has presented to its students or prospectivestudents false or misleading information relating to its instructional program,to the instructional programs of other institutions or to employmentopportunities;

(4)        That the applicantfor or holder of such license has failed to comply with the provisions of anycontract or agreement entered into with a student;

(5)        That the applicantfor or holder of such license has at any time refused to permit authorizedrepresentatives of the Commission to inspect the school, or failed to makeavailable to them upon request full information relating to matters within thepurview of the Commission under the provisions of this Article or the rules orregulations promulgated thereunder; or

(6)        That the applicantfor or holder of such license or any officer of a corporate licensee orcorporation applying for a license, any partner of a partnership licensee orpartnership applying for a license, or any member of a limited liabilitycompany licensee or limited liability company applying for a license haspleaded guilty, entered a plea of nolo contendere or been found guilty of acrime involving moral turpitude in any state or federal court.
