§ 95-110.6. Noncomplying devices and equipment; appeal.

§95‑110.6.  Noncomplying devices and equipment; appeal.

 (a) Whenever the Commissionerdetermines that a device or equipment is subject to the provisions of thisArticle, and that the operation of such device or equipment is exposing thepublic to an unsafe condition likely to result in serious personal injury orproperty damage, he may immediately order in writing that the use of the deviceor equipment be stopped or limited until such time as he determines that thedevice or equipment has been made safe for use by the public.

 (b) Whenever the Commissionerdetermines that the provisions of this Article or the rules and regulationspromulgated thereunder have not been complied with, he may refuse to issue orrenew or may revoke, suspend or amend a certificate of operation.

 (c) Whenever action is takenunder this section, the affected party shall be given notice of theavailability of an administrative hearing and of judicial review in accordancewith Chapter 150B of the General Statutes, the Administrative Procedure Act. (1985(Reg. Sess., 1986), c. 990, s. 1.)
