§95‑192.  Material safety data sheets.

 (a) Chemical manufacturersand distributors shall provide material safety data sheets (MSDS's) tomanufacturing and nonmanufacturing purchasers of hazardous chemicals in NorthCarolina for each hazardous chemical purchased.

 (b) Employers shall maintainthe most current MSDS received from manufacturers or distributors for eachhazardous chemical purchased. If an MSDS has not been provided by themanufacturer or distributor for chemicals on the Hazardous Substance List atthe time the chemicals are received at the facility, the employer shall requestone in writing from the manufacturer or distributor within 30 days afterreceipt of the chemical. If the employer does not receive an MSDS within 30days after his written request, he shall notify the Commissioner of Labor ofthe failure by manufacturer or distributor to provide the MSDS.
