§ 96-12.1. Extended base period for certain job related injuries.

§96‑12.1.  Extended base period for certain job related injuries.

If an individual lackssufficient base period wages because of a job related injury for which hereceived workers' compensation, upon written application by the claimant, anextended base period will be substituted for the current base period on aquarter‑by‑quarter basis as needed to establish a valid claim."Extended base period" means the four quarters prior to theclaimant's base period.  These four quarters may be substituted for base periodquarters on a quarter‑by‑quarter basis to establish a valid claimregardless of whether the wages have been used to establish a prior claim,except any wages earned that would render the Employment Security Commission ofNorth Carolina out of compliance with applicable federal law will be excludedif used in a prior claim.  Benefits paid on the basis of an extended baseperiod, which would not otherwise be payable, shall be noncharged. (1991,c. 409; 1993, c. 343, s. 6.)
