5126.29 Certificated professional or management employees terminating employment.

(A) No professional or management employee in a position that requires a license issued by the state board of education under sections 3319.22 to 3319.31 of the Revised Code or a certificate issued by the director of developmental disabilities under section 5126.25 of the Revised Code shall terminate the employee’s employment contract with a county board of developmental disabilities without obtaining the written consent of the board prior to the termination or giving the board written notice of the termination at least thirty days before its effective date.

(B) Upon complaint by a county board of developmental disabilities that a person holding a license issued under sections 3319.22 to 3319.31 of the Revised Code has violated division (A) of this section, the state board of education shall investigate the complaint. If the state board determines that the person did violate division (A) of this section, it may suspend the person’s license for a period of time not exceeding one year as determined by the state board.

(C) Upon complaint by a county board of developmental disabilities that a person holding a certificate issued under section 5126.25 of the Revised Code has violated division (A) of this section, the director of developmental disabilities shall investigate the complaint. If the director determines that the person did violate division (A) of this section, the director may suspend the person’s certificate for a period of time not exceeding one year as determined by the director.
