282.010Definitions for ORS 282.010 to 282.150. As used in ORS 282.010 to 282.150,unless the context otherwise requires:
(1)“Department” means the Oregon Department of Administrative Services.
(2)(a)“Printed public document” means informational matter produced for publicdistribution regardless of format, method of reproduction, source or copyright,originating in any state agency or produced with the imprint of, by theauthority of or at the total or partial expense of any state agency.
(b)“Printed public document” does not include:
(A)Correspondence, forms, interoffice or intraoffice memoranda;
(B)Legislative bills, calendars and interim committee reports made available underORS 171.206;
(C)Oregon Revised Statutes or any edition thereof; or
(D)Reports and publications of the Supreme Court, the Court of Appeals and theOregon Tax Court.
(3)“Printing” means printing, duplicating and copying. [Amended by 1975 c.605 §1;1993 c.500 §35; 2001 c.539 §1]
282.020Control of state printing and printing purchases. (1) TheDirector of the Oregon Department of Administrative Services or the designee ofthe director shall:
(a)Control and manage all state printing.
(b)Control all state printing purchases, including those outside of the OregonDepartment of Administrative Services; and any printing conducted outside ofthe department on behalf of state government may be conducted only through authorityof the director or the director’s designee.
(2)Printing and binding that advertises or promotes products, agricultural ormanufactured, shall not be considered state printing.
(3)The director or the director’s designee may advertise for bids and awardcontracts for state printing, but the policy of the director or the director’sdesignee in deciding what work shall be let by contract shall be dictated byquestions of good business and economy. 282.025Legislative printing priority required. During sessions of the LegislativeAssembly and immediately thereafter the Oregon Department of AdministrativeServices shall give first priority to the printing of legislative publicationsand materials for the Legislative Assembly, its officers and committees. 282.030Submitting copy specifications for approval by director or designee. (1) Beforebeing printed all copy specifications must be submitted to the Director of theOregon Department of Administrative Services or the director’s designee forreview and approval as to format, style and quality in accordance with rules ofthe Oregon Department of Administrative Services. The director or the director’sdesignee may in the interest of economy, revise the specifications but not insuch a manner as to destroy the purpose or quantity of the copy.
(2)For purposes of this section, “copy specification” does not include anyspecification of the Legislative Assembly or any committee or officer thereof. [Amendedby 1975 c.605 §4; 2001 c.539 §4]
282.040Charges for printing by department. The Oregon Department of AdministrativeServices shall determine and fix the charges to be made for all printing workdone by the department. In determining the charges, the cost of all labor,materials, office expense and depreciation shall be taken into consideration.All printing shall be paid for by the state agency for whose use and benefit itis secured and at the rate fixed and as per invoices rendered by thedepartment. 282.045Symbol on recycled paper. At the discretion of the individual agencydirector, a state agency may print a symbol on paper products selected by theagency director. This symbol shall be determined by the Oregon Department ofAdministrative Services, in consultation with the Department of EnvironmentalQuality, and shall be similar to the following: “Printed on recycled paper.”This symbol may be printed only on recycled paper. 282.050Multiple duplication work. (1) As used in this section, unless the contextotherwise requires, the term “state agency” or “agency” has the meaning giventhat term in ORS 291.002.
(2)The Oregon Department of Administrative Services shall control and regulate theperformance and production of all multiple duplication work required by stateagencies and the purchase and use of multiple duplication equipment, includingbut not limited to xerographic or other copying devices. The department shallitself perform such duplicating services for the state agencies as maypracticably and economically be performed centrally, and for that purpose mayrequire that duplicating equipment possessed by any agency be transferred tothe department. The department further may require transfers of duplicatingequipment between agencies where doing so would result in efficiency andeconomy. Where any duplicating equipment is so transferred to the department orbetween agencies, the proper adjustment shall be made in the accounts andappropriation allotments of the department and of the agencies involved. 282.060Exception to application of state laws where federal funds are involved. Notwithstandingany provision in ORS 282.020 or 282.050 to the contrary, in all cases wherefederal granted funds are involved, the federal laws, rules and regulationsapplicable thereto shall govern.

282.076Athletic departments exempt; exemption for better value services. (1) An athleticdepartment of any university under the jurisdiction of the State Board ofHigher Education shall not be required to use state printing servicescontrolled by the Director of the Oregon Department of Administrative Servicesor the designee of the director as required by ORS 282.020 (1).
(2)A state agency that gives to the director prior written notice of its intent touse other printing services shall not be required to use state printingservices controlled by the director or the director’s designee as required byORS 282.020 (1), if the agency can demonstrate that these other printingservices provide better value in the form of lower prices or betterresponsiveness than those services already provided by the Oregon Department ofAdministrative Services. 282.080State Printer.(1) Subject to any applicable provisions of the Oregon Constitution and theState Personnel Relations Law, the Director of the Oregon Department ofAdministrative Services shall appoint a State Printer. The State Printer shallbe paid out of the Oregon Department of Administrative Services Operating Fundas provided in ORS 282.110.
(2)Subject to any applicable provisions of the Oregon Constitution, the directorshall establish qualifications, duties and a job description for the StatePrinter. [Amended by 1959 c.662 §9; 2001 c.539 §7a]

282.110Use of Oregon Department of Administrative Services Operating Fund. (1) All moneysreceived by the Oregon Department of Administrative Services for printing,ruling and binding shall be promptly deposited in the State Treasury to thecredit of the Oregon Department of Administrative Services Operating Fundcreated by ORS 283.076.
(2)In addition to the other purposes for which the Oregon Department ofAdministrative Services Operating Fund may be used, the Oregon Department ofAdministrative Services Operating Fund hereby is appropriated continuously forand may be used for the purchase of all supplies and the payment of all laborand expense, including equipment and facilities, connected with the department’sprinting, publishing and distribution activities. The administrative costsincurred in the operation of the Oregon Department of Administrative ServicesOperating Fund for the purposes of this section shall be paid from the accountand shall be added to the costs of the department’s printing, publishing anddistribution activities. 282.150Printing inaugural address of Governor. At the inauguration of a Governor, theOregon Department of Administrative Services shall cause to be printed suchnumber of copies of the inaugural address as the Governor-elect directs. [Amendedby 1957 c.230 §1; 1975 c.605 §10; 2001 c.539 §9]

282.210Performance within state of public printing, binding and stationery work;stipulation in request for bids and in contracts; exceptions. (1) Except asprovided in subsection (2) of this section, all printing, binding andstationery work, including the manufacture of motor vehicle registration platesand plates required to be affixed to motor carriers, for the state or anycounty, city, town, port district, school district, or other politicalsubdivision thereof, shall be performed within the state. All requests for bidsand all contracts for such work shall so stipulate.
(2)The work referred to in subsection (1) of this section may be performed outsidethe state if it is established that:
(a)The work cannot be performed within the state;
(b)The lowest price for which such work can be procured within the state exceedsthe charge usually and customarily made to private individuals and corporationsfor work of similar character and quality; or
(c)All bids for the work, or any part thereof, are excessive and not reasonablycompetitive. [Amended by 2003 c.758 §2]
282.220Payment for unauthorized work outside state prohibited. No paymentshall be made by the state or any political subdivision thereof for printing,binding or stationery work, including the manufacture of motor vehicleregistration plates and plates required to be affixed to motor carriers, unlessit appears that such work was done within the state, or was authorized to bedone outside the state pursuant to ORS 282.210. 282.230Provisions required in contracts for work to be done outside of state. (1) Allcontracts for work to be performed outside the state under ORS 282.210 shallprovide and require that such work shall be performed under conditions of laborand employment which shall substantially conform to the laws of this staterespecting hours of labor, the minimum wage scale for women and minors, and therules and regulations promulgated by the Wage and Hour Commission of the Stateof Oregon regarding conditions of employment, hours of labor and minimum wages.
(2)Violation of the provision required by subsection (1) of this section shall begrounds for cancellation of the contract.
PENALTIES
282.990Penalties.The provisions of ORS 291.990 apply to ORS 282.020 and 282.050. Any violationof ORS 282.040, 282.050 and 282.060 shall, upon conviction, be punished asprescribed in ORS 291.990.
