6909 - Misbranding.
§ 6909. Misbranding. No person shall distribute a misbranded soil amendment or plant amendment. A soil amendment or plant amendment shall be deemed to be misbranded if: (1) its labeling is false or misleading in any particular manner; (2) it is distributed under the name of another soil amendment or plant amendment product; (3) it is not labeled as required in section 6905 (relating to labels and labeling) and in accordance with regulations prescribed under this chapter; (4) it purports to be or is represented as a soil amendment or plant amendment or is represented as containing a soil amendment or plant amendment unless such soil amendment or plant amendment conforms to the definition of identity, if any, prescribed by regulation of the department; or (5) it does not conform to ingredient form, minimums, labeling and tolerances prescribed by regulation.
