3712.2 - Stripping abandoned vehicles.

§ 3712.2. Stripping abandoned vehicles. (a) Offense defined.-- (1) Except as provided in paragraph (2), a person commits the offense of stripping an abandoned vehicle if the person intentionally removes any part of an abandoned vehicle. (2) Paragraph (1) does not apply if the person: (i) is the owner of the vehicle or the owner's agent; or (ii) is authorized to make the removal under Chapter 73 (relating to abandoned vehicles and cargos). (b) Penalties.--Any person violating subsection (a): (1) For a first offense, commits a misdemeanor of the third degree. (2) For a subsequent offense, commits a felony of the third degree. (c) Complaints.--In a case involving a violation of this section, the municipality in which the vehicle is located may file the complaint with the appropriate issuing authority.
