SECTION 10-13-24

   § 10-13-24  Assignment for benefit ofcreditors upon administration of oath. – Whenever the oath as provided in this chapter shall be administered to anydefendant, under the provisions of §§ 10-13-14 – 10-13-23 he orshe shall then and there make an assignment of all his or her estate, real andpersonal, not exempted from attachment by law, to some responsible inhabitantof this state, his or her heirs and assigns, to be approved by the magistrateadministering the oath, in trust for the benefit of all his or her creditors inproportion to their demands, and a copy of the assignment shall be filed by theassignee in the office of the clerk of the court issuing the execution.
