SECTION 11-1-11

   § 11-1-11  Felons prohibited frompossession of radio scanners. – No person: (1) who has been convicted of a felony violation of chapter 28 oftitle 21 involving the illegal manufacture, sale or delivery or possession withintent to manufacture, sell, or deliver a controlled substance classified inSchedule I or II; or (2) who has been convicted of a felony in violation ofchapter 8 of this title involving the burglary or breaking and entering of adwelling house or apartment, whether the house or apartment is occupied or not,any business place, or public building, with the intent to commit larceny;shall carry, transport, or have in his or her possession, or under his or hercontrol outside of his or her own home, any operational police radio, policescanner, or any other device capable of monitoring police broadcasts. Everyperson violating the provisions of this section shall, upon conviction, bepunished by imprisonment for not more than five (5) years, or a fine of notmore than five thousand dollars ($5,000), or both.
