   § 11-52.3-5  Penalties. – (a) Any person convicted of any offense under §§ 11-52.3-2 and11-52.3-4, if the value of the property is less than five hundred dollars($500), shall be guilty of a misdemeanor and shall be imprisoned for not morethan one year, or by a fine of not more than one thousand dollars ($1,000), orboth. If the property has a value of five hundred dollars ($500) or more, theperson shall be guilty of a felony, and shall be imprisoned for not more thanten (10) years, or by a fine of not more than five thousand dollars ($5,000),or both.
