SECTION 12-12-1.7

   § 12-12-1.7  Motion to dismiss information.– Within thirty (30) days after a defendant is served with a copy of aninformation charging him or her with an offense, he or she may move in thesuperior court to dismiss the information on the ground that the informationand exhibits appended to it do not demonstrate the existence of probable causeto believe that the offense charged has been committed or that the defendantcommitted it. Upon the filing of the motion to dismiss the court shall schedulea hearing to be held within a reasonable time.
