SECTION 12-12-1.9

   § 12-12-1.9  Determining whether probablecause exists. – After conducting the hearing the court shall determine from an examination ofthe information and exhibits appended to it, and in light of any evidencepresented at the hearing, whether there exists probable cause to believe thatthe offense charged has been committed and that defendant committed it. Afinding of the existence of probable cause may be based in whole or in partupon hearsay evidence or on evidence which may ultimately be ruled to beinadmissible at the trial.
