SECTION 12-12-18

   § 12-12-18  Period of limitations extendedby theft, loss or destruction of indictment or information. – If any indictment found or information filed within the time limited in and bythis chapter shall be stolen, lost, or destroyed before a judgment shall havebeen rendered, a new indictment may be found or information filed for the sameoffense at any time within one year after the theft, loss or destruction of theoriginal indictment or information.
