SECTION 12-16-5

   § 12-16-5  Taking into custody and deliveryof witness. – If the certificate recommends that the witness be taken into immediate custodyand delivered to an officer of the requesting state to assure his or herattendance in the requesting state, the judge may, in lieu of notification ofthe hearing, direct that the witness be immediately brought before him or herfor the hearing; and the judge at the hearing, being satisfied of thedesirability of custody and delivery, for which determination the certificateshall be prima facie proof of that desirability, may, in lieu of issuingsubpoena or summons, order that the witness be immediately taken into custodyand delivered to an officer of the requesting state.
