SECTION 12-21-2

   § 12-21-2  Limitation of prosecutions.– All suits or prosecutions founded upon any penal statute, which are wholly orin part for the use of the prosecutor, shall be brought within one year, andall other suits and prosecutions on a penal statute within two (2) years afterthe commission of the offense, unless otherwise specially provided.
