SECTION 18-7-6

   § 18-7-6  Transfer authorized by will ortrust. – (a) A personal representative or trustee may make an irrevocable transferpursuant to § 18-7-10 to a custodian for the benefit of a minor asauthorized in the governing will or trust.

   (b) If the testator or settlor has nominated a custodianunder § 18-7-4 to receive the custodial property, the transfer must bemade to that person.

   (c) If the testator or settlor has not nominated a custodianunder § 18-7-4 or all persons nominated as custodian die before thetransfer or are unable, decline, or are ineligible to serve, the personalrepresentative or the trustee, as the case may be, shall designate thecustodian from among those eligible to serve as custodian for property of thatkind under § 18-7-10(a).
