SECTION 2-10-13

   § 2-10-13  Enforcement. – It is the duty of the director of environmental management or his or herauthorized representative to enforce the provisions of this chapter and ofchapter 15 of this title and to prosecute any person, firm, or corporation,that, in his or her opinion, is guilty of the violation of any of theprovisions of this chapter, and in all those prosecutions the director or thedirector's authorized representative is not required to enter into anyrecognizance or to give surety for costs. It is the duty of the attorneygeneral to conduct the prosecution brought by the director under the provisionsof this chapter and of chapter 15 of this title.
