   § 21-18-7  Prosecution of violations.– When the director of environmental management becomes cognizant of theviolation of any provision of this chapter, he or she shall cause notice of theviolation together with a copy of the findings to be given to the person orpersons concerned. Persons notified shall be given a hearing under rules andregulations prescribed by the director. Notices of the hearing shall specifythe date, hour, and place of the hearing. Whenever any prosecution takes place,the state director of environmental management shall not be required to furnishsurety for costs, upon any complaint made by him or her.
