§ 23-13.4-3 - Manufacturing, processing or distribution.
SECTION 23-13.4-3
§ 23-13.4-3 Manufacturing, processing ordistribution. – (a) Effective January 1, 2007, a person may not manufacture, process, ordistribute in commerce a product or a flame-retardant part of a productcontaining more than one-tenth (1/10%) of one percent (1%) of pentaBDE oroctaBDE.
(b) Subsection (a) of this section does not apply to thefollowing:
(1) The sale by a business, charity, or private party of anyused product containing PBDE.
(2) The distribution in commerce of original equipmentmanufacturer replacement service parts manufactured prior to July 14, 2006.
(3) The processing of recycled material containing pentaBDEor octaBDE in compliance with applicable state and federal laws.
(4) Use of products containing small quantities of PBDEs thatare produced or used or used for scientific research on the health orenvironmental effects of PBDEs.
