SECTION 23-17.9-9

   § 23-17.9-9  Penalties for violations.– It shall be a misdemeanor punishable by a fine of not more than five hundreddollars ($500) and/or by imprisonment for not more than one year for any personto:

   (1) Obtain his or her certification or registration by meansof fraud, misrepresentation, or concealment of material facts;

   (2) Practice as a nursing assistant under cover of anycertification or registration illegally or fraudulently obtained or unlawfullyissued;

   (3) Practice as a nursing assistant during the time his orher certification or registration issued under the provisions of this chaptershall be suspended or revoked; or

   (4) Otherwise violate any of the provisions of this chapter.
