SECTION 23-18.9-8.1

   § 23-18.9-8.1  Criteria for public andprivate licenses. – (a) The director shall grant licenses only to those public facilities which thedirector determines meet all relevant criteria by regulation to protect humanhealth and the environment and which are reasonably required to dispose ofwastes generated within this state. All public projects shall meet the criteriafor need established in § 23-19-4(b) and the director shall require nofurther demonstration of need.

   (b) The director shall grant licenses only to those privatefacilities which he or she determines meet all relevant criteria established byregulation to protect human health and the environment.
