§ 23-24.6-19 - Fugitive dust.

§ 23-24.6-19 Fugitive dust. – (a) The department of environmental management shall revise its air pollutioncontrol regulation number 5 relating to "fugitive dust", developed underauthority conferred by the Clean Air Act, chapter 23 of title 23, so as toprevent the uncontrolled dispersal of lead bearing dust into the air and soil.The revised regulations shall control all sandblasting and powered sanding ofexterior surfaces with lead containing paint or surface coatings underconditions specified by the department of environmental management.
(b) In addition to any other authority currently held, thedepartment of environmental management shall have the authority to conduct soilsampling and other appropriate environmental lead sampling in enforcing the airpollution control regulation number 5 relating to "fugitive dust".
