SECTION 23-38-2.2

   § 23-38-2.2  Readily removable caps, lids,or rings. – (a) No beverage shall be sold, offered for sale, or distributed within thestate in a plastic container composed of more than one resin, excluding thecap, lid, or ring for the container. The cap, lid, or ring of the containershall be readily removable from the body of the container.

   (b) This section shall not apply to containers that arerecycled or can be demonstrated to be recyclable, or if the manufacturer canshow that more than one resin is necessary to preserve product integrity.

   (c) The department of environmental management shallpromulgate rules and regulations pertaining to this section.
