SECTION 23-63-2

   § 23-63-2  Disposal of used vehicle rubbertires – Burning prohibited – Storage restricted. – (a) No person shall dispose of any vehicle tire within the state except bydelivery of the tire to a facility operated by the Rhode Island resourcerecovery corporation designated for that purpose, or to a privately operatedtire storage or tire recycling or recovery facility licensed by the director ofenvironmental management for that purpose or by delivery for transportation toan out-of-state recycling facility. Prior to the delivery of any vehicle tirefor export to any tire-burning facility outside the state, and within thirty(30) miles of the Scituate Reservoir watershed, the department of environmentalmanagement shall consult with the appropriate state agency regulating suchtire-burning facility and shall receive assurances in writing from the agencythat the facility meets all applicable state and federal pollution controlstandards.

   (2) The burning of used tires within the state is prohibited.

   (b) No person not licensed under the provisions of §23-63-4 shall store more than four hundred (400) used vehicle tires at anylocation within the state. Any person not in compliance with this section onJuly 11, 1989 shall have one year from that date to effectuate compliancepursuant to the provisions of subsection (a).
