SECTION 23-63-3

   § 23-63-3  Environmental impact statement– Necessity – Approval of director. – No export of tires for burning shall be permitted to a facility which has notsubmitted to the satisfaction of the director, in accordance with reasonablerules and regulations, an environmental impact statement conforming to theUnited States environmental protection agency standards. Upon the filing of asatisfactory environmental impact statement, the director shall conduct apublic hearing seeking public comment prior to granting final approval of thestatement and approval of the export of the tires. The environmental impactstatement shall be required regardless of whether it is required at thefacility site by the United States environmental protection agency regulations.
