SECTION 24-3-13

   § 24-3-13  Payment of damages awarded– Action against town. – The town or city shall, within four (4) months after the confirmation of thereport of the commissioners, pay to the person entitled thereto the amount ofdamage finally awarded upon the report. In the case of a default of thepayment, the person entitled to the payment, after application to the town orcity council for payment thereof, may sue the town or city for and recover thepayment, with interest. In the suit it shall be sufficient to declare generallyfor so much money due the plaintiff, by virtue of this chapter, for premisestaken for the purpose herein mentioned; and the plaintiff may give any specialmatter in evidence under a general declaration, with proof of the right of theplaintiff to the sum demanded.
