§ 24-5-10 - Taking of road materials from adjoining land.

SECTION 24-5-10

   § 24-5-10  Taking of road materials fromadjoining land. – Any surveyor of highways may, with the consent of the town council or committeethereof having care and direction of his or her district, for the purpose ofobtaining materials for repairing any highway, enter upon and dig for stone,gravel, clay, marl, sand, or earth in any adjoining land not forming a part ofthe messuage connected with any dwelling house, or not used as a cemetery orburial ground or otherwise appropriated to the burial of the dead; and mayremove the material thus dug up to a place or places in the highways for therepair and amendment thereof as the surveyor shall deem necessary; provided,that land which is platted in house lots, and the plat thereof recorded in theland records of the town where it lies, shall not be so entered upon.
