§ 27-10-1 Applicability. The provisions of this chapter shall apply to insurance claim adjusters. Forthe purposes of this chapter "insurance claim adjusters" means any person, whoor which:
(1) Engages for compensation in negotiating adjustments ofinsurance claims on behalf of an insurance company, other than life andaccident and health insurance claims, under any policies of insurance or whoadvertises or holds himself or herself out as engaging in that activity or whosolicits that activity;
(2) Is known or holds himself, herself, or itself out as a"public adjuster". A public adjuster is any person who, for compensation or anyother thing of value on behalf of the insured:
(i) Acts or aids, solely in relation to first party claimsarising under insurance contracts, other than automobile, life, accident andhealth, that insure the real or personal property of the insured, on behalf ofan insured in negotiating for, or effecting the settlement of, a claim for lossor damage covered by an insurance contract;
(ii) Advertises for employment as a public adjuster ofinsurance claims or solicits business or represents himself or herself to thepublic as a public adjuster of first party insurance claims for losses ordamages arising out of policies of insurance that insure real or personalproperty;
(iii) Directly or indirectly solicits business, investigatesor adjusts losses, or advises an insured about first party claims for losses ordamages arising out of policies of insurance that insure real or personalproperty for another person engaged in the business of adjusting losses ordamages covered by an insurance policy, for the insured; or
(3) Advertises or solicits business as an adjuster, or holdshimself or herself out to the public as engaging in adjusting as a business.
