§ 27-18-46 Penalties and remedies. (a) Any person, firm, corporation, association or other legal entity who orwhich shall violate the provisions of § 27-18-45 shall be guilty of amisdemeanor, and upon conviction, shall be fined in an amount of not more thanone thousand dollars ($1,000), imprisonment for up to one year, or by both fineand imprisonment.
(b) In addition to the criminal sanctions set forth insubsection (a) of this section, any person, firm, corporation, association orother legal entity who or which shall willfully or negligently violate anyprovision of this chapter shall be subject to a civil penalty, to be assessedby the insurance commissioner, in the maximum amount of five thousand dollars($5,000) for each violation, and each violation shall constitute a separate anddistinct offense under this section.
