SECTION 27-29.1-4

   § 27-29.1-4  Mandate to offer anonrestricted pharmacy network. – Every health care insurer that delivers or issues for delivery or renews inthis state a contract, plan, or policy that provides coverage forpharmaceuticals delivered on an outpatient basis through a restricted pharmacynetwork, shall:

   (a) Also offer insurance purchasers an optional benefit planthat includes a nonrestricted pharmacy network; and

   (b) Subject to a determination by the US Department of Healthand Human Services' Centers for Medicare and Medicaid Services on theconsistency of this subsection with Medicare law and related regulations, offeronly nonrestricted pharmacy networks in any Medicare Supplement orMedicare+Choice Plans.
