SECTION 28-10-8

   § 28-10-8  Penalty for use of gas. –(a) Any person violating any of the provisions of § 28-10-7 shall beliable for and required to pay a civil penalty in the amount of five hundreddollars ($500) for each and every offense. The civil penalty may be assessed inan action brought on behalf of the state in any court of competent jurisdiction.

   (b) Each individual on whom tear gas, brombenzylcyanide, orany other gas is used which would affect respiratory organs shall be considereda separate offense for the purpose of this section.
