SECTION 32-4-9

   § 32-4-9  State grants – Application.– A state grant to assist a local unit to acquire lands for recreation andconservation purposes shall not be made under this chapter until:

   (1) The local unit has applied to the director on formsprescribed by the director:

   (i) Describing the lands for the acquisition of which thegrant is sought;

   (ii) Stating the recreation and/or conservation purpose orpurposes to which the lands will be devoted, and the facts which give rise tothe need for the lands for that purpose;

   (iii) Setting forth a comprehensive plan for the developmentof the lands approved by the governing body of the local unit; and

   (iv) Stating such other matters as the director shallprescribe;

   (2) The director shall have prescribed the terms andconditions under which the grant applied for will be made; and

   (3) The local unit shall have filed with the director itsacceptance of the terms and conditions, and has otherwise complied with theprovisions of this chapter.
