SECTION 33-11-10

   § 33-11-10  Bond to cover contingent claim.– If a party interested in the estate offers to give bond to the contingentcreditor, with sufficient surety or sureties for the payment of the claim incase it shall be proved to be due, the probate court may accept a bond insteadof requiring assets to be deposited as provided in § 33-11-9. But nothingcontained in this section shall be construed to prevent any party holding thecontingent claim from waiting until its right of action accrues, and thenbringing suit against the heirs, devisees, legatees or next of kin, as providedin this chapter.
